James Logan student fights suspension in court
A 14 year old James Logan High School student from the New Haven district has sued Alameda County Superior Court to overturn a suspension. Attorney Rick Ramirez of Union City says the student was summarily suspended after talking back to a teacher without a hearing and argues a state education code was violated. Attorney Frausto from Legal Aid says a hearing was scheduled before Judge Lionel Wilson and that the district must explain the suspension. The judge issued an alternative writ ordering reinstitution of Ramirez, with district action delayed beyond the hearing since the suspension is in effect through June 6. The mother says this is not the first time the student faced a suspension without a hearing. The district says it cannot comment until June 15.
