Supreme Court to study profanity
The Supreme Court agreed to review an 8th circuit ruling striking down a Georgia law that could label abusive language a breach of the peace. Judge Sidney G. Smith Jr in Atlanta voided a month prison term for Johnny C. Wilson, a Black man convicted of shouts at an antiwar demonstration in 1968. The 5th Circuit affirmed. Georgia argues only a federal judge can assess constitutionality in such actions. The case prompts a three judge panel setup, with Wilson facing assault and battery charges plus federal counts.
