Court narrows power to halt strikes under Railway Act
Justice Harlan leads a majority holding federal judges may issue injunctions to block a strike if one side shows efforts toward settlement, even if normal processes aren t exhausted. Case involved Chicago and North Western Railway Co and United Transportation Union over crew size and a pending strike after mediation deadlines. Dissenting justices Black, Douglas, White oppose the ruling. The ruling interprets the Railway Labor Act covering railway and airline employees and the dispute stemmed from brakemen staffing on trains. The Seventh Circuit had upheld a provisional injunction, with the lower court ruling non justiciable.
