Judge Lindsay Rules Boston and Montana Proper Plaintiff
Judge Lindsay ruled the Boston and Montana company was the proper plaintiff to sue the Montana Ore Purchasing company while the property remained in the plaintiff's control, over ruling the plea in abatement. He said an actual possessor may sue for wrongful taking, and the receiver's current rights, if any, did not negate the plaintiff's standing. The decision covered several other civil matters and adjourned to Monday for further testimony.
