Jury rules smoking can cause cancer in landmark Pittsburgh case

A U S district court jury found cigarette smoking can cause lung cancer but tobacco maker Liggett and Myers was not liable for damages. Otto Pritchard, a 64 year old Pittsburgh carpenter, smoked Chesterfield cigarettes from the 1920s to 1950s, leading to lung cancer and loss of a kidney. The panel said smoking was a cause or one of the causes but that Pritchard assumed risk by starting to smoke. The verdict framed smoking risk as not product liability. The six week trial, its second retry, sought 218000 dollars. The judge instructed the jury on the first question.
