Dunkirk Cop Slayer Maps New Appeal

Leo J. Mieczko, 51, former Dunkirk resident now serving 30 years to life for the 1961 shooting death of Dunkirk Police Lt. Mark Elfman, has begun a second appeal from his second degree murder conviction. He was tried in Ontario County in 1962 after a venue change from Chautauqua County. His first appeal argued the confession to Dunkirk police was involuntary due to sedation at Brooks Memorial Hospital. Justice Braser denied a ruling on voluntariness. An Appellate Division review followed. If granted, a new trial could be held with the confession excluded.
