Suspicion Not Grounds For Arrest in Local Detention Policy
The State Justice Department ruled that suspicion alone cannot justify detaining a person in a local jail. A 1909 law allows temporary imprisonment up to 48 hours without a committing magistrate if unavailable, but arrests must be based on probable cause and charges filed for a specific offense. In a separate crash, Mrs. Sarah Dison, 75, died after witnessing a head-on collision near Hiram, while occupants of the other car sustained minor injuries.
