Law question arises in Buffalo trolley collision case

Mayville February 27 A new legal point surfaced in the Supreme Court during the trial of Mary Lammatina’s $20,000 negligence suit against the Buffalo and Lake Erie Traction Company. The defense sought to label the driver as a trespasser, arguing an owner or operator of an unlicensed auto cannot recover for negligence damages, citing a Massachusetts ruling. The judge noted no New York ruling yet on this issue and emphasized the need to consider an innocent third party’s right to damages. Five related suits stem from the same auto trolley crash with the plaintiff alleging $95,000 in damages.
