Leo J. Mleczko, 46, a former Dunkirk resident serving 35 years to life for the 1961 slaying of Dunkirk Lt. Mark Elfman, lost a civil rights suit against Dunkirk city, Brooks Memorial Hospital, and a nurse. Supreme Court Justice Reid S. Moule dismissed the $100,000 suit, ruling it failed to state a cause of action and that the plaintiff’s imprisonment suspends his right to sue. The suit contended a police bullet caused the shooting and that a nurse burned a shirt with a bullet hole, which Mleczko argued would prove accident.
