Poisoned Pole Liability Shifts To Dayton Firms
In a federal decision Judge Thompson finds Dayton Lighting Company and Central Union Telephone Company jointly responsible for William Toohey’s death. Toohey, a telephone employee, fell from a rotten twenty year old pole after being sent to adjust wires. Each company must answer for $10,000 damages. The ruling cites a mutual pole-use agreement and shared duty to keep poles safe. An unrelated Michigan appeal involves George Maas and Cleveland Cliffs Iron Company disputing Wisconsin mining property ownership with Margaret Lanstorf.
