Imprisoned For No Crime Wah Cleared On Indictment
Yee Ting Wah a 61 year old Chinese laundryman of 1017 East McMillan street after serving two years in Atlanta federal prison and nearing deportation to China on a narcotic charge was told yesterday that the indictment was defective and did not charge a crime. The appeal granted due to lack of knowledge of illegal opium import. Another man arrested with him but who did not appeal is en route to China. Wah will be allowed to stay but cannot recover the eighteen months he served. Wah was arrested July 1925 by federal narcotic inspectors at his McMillan street address for opium smoking with two fellow countrymen. He was released at end of eighteen months in June this year but arrested again at prison gates on a deportation warrant and held in Atlanta. Attorney August J. Knapp appealed to the Commissioner General of Immigration and Wah was released on bond pending the appeal. The appeal was granted because the indictment failed to show he knew opium was smuggled and illegal.
