Insurance Agents Liable for Gross Sales Tax, Court Rules

The West Virginia Supreme Court ruled that fire and casualty insurance agents are liable to pay gross sales tax at 1 percent of their commissions, rejecting the notion that a 2 percent levy on insurance companies exempts agents. The decision, issued in Kanawha County, upholds the service business definition and applies to agents statewide. The same day the court issued its opinion on the Wayne County primary case, holding county commissioners lack legal right to conduct the original vote count.
