Prisoner's Case Under Study By Judge Moore

MOUNDSVILLE June 14 Arguments on challenging the 1935 indeterminate sentence law were taken under advisement by Special Circuit Judge Everett F. Moore. D B Cohn of Wood county, who obtained a writ of habeas corpus, contends the law is unconstitutional as it vests judicial power in an administrative body. The state parole and probation department altered Cohn's one year term for a bad check to a one to five year sentence. Cohn's term ended last month. About 300 inmates with post law sentences could be affected. Prosecutor J W Rickey moved to quash the writ, citing a similar Iowa case.
