Mingo Man Killed in Footpath Dispute Near Breeden
Deputy Sheriff James L. Dent said a dispute over a Breeden area footpath led to the fatal shooting of 33 year old Alice Vance Kirk. Albert Maynard, 33, faced a murder charge after the slaying occurred yesterday as he, while employed by United Fuel Gate, checked gas gauges. Maynard quoted the Kirks as opposing his path use on their property along Twelve Pole Creek. Dent noted ongoing statements from Maynard.
Dent fired single shot on fear of attack
Dent and Deputy Sheriff Dave Johnson said Maynard fired a pistol on the Over Foot Path after fearing an object would be thrown at him. The shot occurred before Mrs. Kirk’s 11 year old daughter and a sister in law. Maynard waited on his porch as deputies recovered the weapon and took him to Mingo county jail.
