Hiawatha Council Delays 1380 Appeal Decision

The Hiawatha city council postponed ruling on appealing Linn district court findings against the city amid a dispute with the county regional planning commission. An executive session with City Attorney Clinton Moyer lasted about 30 minutes. A May 18 decision appears likely at the next regular meeting. Judge Ansel Chapman had overruled the city’s motion for a new trial. The dispute centers on whether a majority of all commission members or a majority of those present is required to approve the plan. The interpretation of state statutes and commission by laws could influence 1380 interchange decisions for Hiawatha.
