Judge rules against DNR over anti-degradation in Des Moines River case
Iowa district court faults DNR for approving Clarion wastewater project without full environmental benefit analysis under anti-degradation standards. Ruling, issued March 17 by Judge Michael Huppert, requires reconsideration of the design to account for nutrient reduction. Environmental groups hailed the decision as enforcing the 2014 Iowa Supreme Court stance on evaluating environmental benefits.
