Cedar Rapids Architect Zalesky Fee Suit Demurrers Upheld
Judge Heiserman sustained Cedar Rapids demurrers to a 2000 amended third count in Charles B Zalesky’s architect fee suit over plans for the police station and jail. Judge Ring upheld city demurrers to the 240 second count and third count seeking 3000, and the city counterclaimed 37507 claiming sewer drain traps did not meet ordinances. The city argued plan revisions after bids did not warrant extra pay and that council actions or individual members’ promises could not bind the city.
