Iowa CAFO nuisance shield upheld by Supreme Court ruling
The Iowa Supreme Court on a unanimous decision preserved a shield law protecting large animal feeding operations from nuisance lawsuits, while allowing neighbors to sue if they prove the CAFO did not actually benefit them and that their hardship remains. The ruling preserves the Gacke standard for case by case review and sends the case back to lower court for further proceedings.
