Iowa Residency Rule on Divorce Not Constitutional Right
In a split ruling the majority held Iowa one year residency for divorce not a constitutional right and must meet strict equal protection. McManus dissented arguing the state has a legitimate interest and the ban on bona fide residents seeking dissolution may not be justified. Sosna challenged the one year requirement after moving from New York to Iowa with children, seeking to void Iowa’s no fault divorce act.
