Burr count dismissed in Cedar Rapids false arrest suit
The Cedar Rapids man Eldon Burr sees the fifth count of his $4 million petition against Linn County and an assistant county attorney dismissed by Linn District Judge Robert Osmundson. The ruling follows a prior dismissal of the first four counts by Judge Robert Ford last November. The suit still involves city and state agencies. Ford’s ruling was appealed to the Iowa Supreme Court. Burr, 54, had been charged last year with attempting to murder his wife Theda by gifting candy sprayed with nicotine. The charge was dismissed in June as the toxic amount differed from initial reports. The suit claims a BCI lab employee failed to detect nicotine in the candy. Assistant County Attorney John Ehrhardt is named in his prosecuting role and immunity for acts in office is cited as the reason to dismiss.
