High Court Rules Dismissal Does Not Guard Against Reprosecution
Des Moines Iowa Supreme Court in an 8 1 decision held that a judge dismissal of criminal charges does not always shield a defendant from further prosecution. The ruling involved Dennis Buckley in Humboldt County where charges were dropped after a speedy trial limit had not yet become law. Justice Clay LeGrand dissented noting double jeopardy is an unqualified prohibition. The court also overturned two convictions due to mishandling by lawyers and judges, including Kenneth Robert L Hotz who was punched outside a bar and treated at Mercy hospital.
