Judge Allows Drill Sergeants to Use No Force in Rape Conviction
In court martial at Aberdeen Proving Ground, Col. Paul Johnston rules drill sergeants have so much authority that constructive force can be established without weapons or threats. He will let the 19 rape counts proceed, while noting sex with a trainee by a sergeant is not automatically rape. Staff Sgt. Delmar Simpson faces possible life for a single rape conviction amid testimony from six accusers. The verdict hinges on whether circumstances meet rape criteria.
