Supreme Court Rules Against Towns on Crossing Gates
Indiana Supreme Court decision favors railroads over towns, ruling no incorporated city may compel railroad firms to install gates or station flagmen at street crossings. Judge Monks differentiates power to regulate speed inside city limits from mandating gates and watchmen on private property. The Crown Point case centered on an ordinance demanding gates and flagmen for P C C and L A R Co crossings. He notes sections may allow non onerous controls to prevent obstructions but not funding or erecting gates or watchmen.
