The American Federation of Labor surveys show profits up 36 percent in early 1938 while wages rise only 4.8 percent and living costs climb 2.8 percent. Employment and buying power lag, with 12,184,600 unemployed and re-employment behind recovery.
Major railroads and terminal companies including the Pullman Company contest the latest railroad retirement acts in district of columbia supreme court. They argue the measures are unconstitutional despite prior acts passed in 1934 and subsequent amendments aimed at addressing judicial objections.
Two mines in the district, employing 450 workers, were closed on May 20 following the supreme court ruling against the Guffey Act. PT Fagan of the United Mine Workers said miners were told the mines had operated at a loss in hopes the act would be upheld.
The Supreme Court, by a close vote, held the labor provisions of the Guffey coal act unconstitutional. Justice Sutherland notes the act aimed to regulate local labor issues, yet the majority finds coal business largely local in nature with most mines outside West Virginia and coal shipped to other states. The ruling blocks federal remedies for industrial evils in coal.
President Roosevelt, on May 21, appointed a three member emergency board to investigate a wage dispute among the Western Pacific Sacramento Northern and Tidewater Southern railroads and their engineers firemen trainmen and conductors. The board includes G Stanleigh Arnold Macy Nicholson and Will J French and aims to report on the stalled pay negotiations.
Buffalo New York WPI service reports that Remington Rand Inc workers threaten strike but union leaders say company officials will negotiate for higher wages.
Washington reports the Works Progress Administration lists 1,480,822 needy persons attending its free classes surpassing the expected number of graduates from college and high school. The program aims to broaden access to education for the unemployed and impoverished citizens.
