Moulin y.orf., 11 the Burnet county Burnet a charges of political motivations were Given today by George and Joan Puckett As Poss Ible reasons for a $25,000 lawsuit filed against them by Bertram resident Doyle Knight. Puckett said he filed a general denial of the allegations listed in the libel suit tuesday in 33rd District court. Quot i consider this lawsuit to be a spurious action on the part of the Young and inexperienced attorney who has seen fit to file the suit. And i feel it is no doubt politically motivated Quot Puckett said. Quot we Are presently investigating counteraction which May be appropriate Quot he added. Quot i also intend to serve As counsel in this Case because it is evident that the suit has so Little Merit Quot he said. Puckett added that he and the bulletin have received numerous offers from Bertram residents to testify when the Case comes to court a All of them so far unsolicited. The libel action was filed in 33rd District court october 14 by Austin attorney Sam Kindred on behalf of Knight following publication of a cartoon in the August 29, 1977, edition of the bulletin. Knight alleges the cartoon exposed him to Quot Public hatred and ridicule and his honesty integrity and virtue have been Quot said cartoon was false unfair malicious reckless libellous and defamatory a the suit alleges. Quot it has exposed plaintiff to Public Wrath hatred contempt and ridicule and has deprived him of the benefits of. Public Confidence and of social Intercourse. The publication of the cartoon was cruel and malicious in utter disregard to plaintiff s feelings and reputation As Well As the feelings and reputation of his the libel suit alleges that Knight has suffered Quot mental distress and anguish mortification grief shame and embarrassment Quot and has caused him actual damages of $15,000 Knight further is asking the court Tot Quot a exemplary damages Quot of $10,000. The petition filed in District court alleges that Quot at and before the time of the publishing of the matters hereinafter complained of Knight was a respected upright and honorable citizen of Bertram enjoying the esteem respect and Confidence of his friends neighbors and fellow the suit further alleges that the cartoon constituted an Quot unwarranted invasion of Knight s right of privacy to be left alone free from unwarranted publicity and intrusion into his personal life and the intrusion by Joan and George Puckett is described As Quot wilful Quot and Quot an act of reckless indifference As to the effect on Knight s Well being and the bulletin having been contacted by Doyle Knight s attorney Sam Kindred ran an apology on sept. 12, 1977, to Knight a As kids c of c Burnet a new officers of the Burnet chamber of Commerce were elected tuesday morning during a breakfast at the Tower restaurant. The new president of the chamber is Roy Murray who replaces president Jerry Cozby. First vice president is Herman Braley and second vice president is Markle Williams. The chamber s new treasurer is Charles Brinkley. Four new Board of directors members were also announced. They Are Dwayne Teague Richard Sanders. Merkle Williams and Dan Bailey. I xxx t ont or in r a c a Rex 3 or 1133, Texas 73335 Fry elected mayor pro tem Council okays Industrial Park water line plan by Joan Puckett Burnet Burnet City Alderman James Fry was elected mayor pro tem during tuesday night s special City Council meeting by a 4 1 vote. The Lone dissenting vote was cast by Alderman Dan Haynes. Voting for Fry were aldermen Derell Cowan . Seidensticker Bill Wilcox and Fry. The Council also took action on bid requests which had been discussed during previous meeting. Bids were received for a video tape deck and for a color television receiver for the Burnet county free Library a which is to be paid for with a $2,500 allocation from Revenue sharing funds. Low bids were accepted for both items and both Are to be purchased from Texas video systems in san Antonio for a total of $2,080 the bids however were accepted by a 3 2 vote in both cases with Wilcox and Haynes voting against and Fry Cowan and Seidensticker voting for. The Council unanimously rejected a $2,995 bid received from Merkle Williams on a 1975 automobile with a police package. The police Type vehicle was the subject of discussion during two previous meetings and was offered to the City several months ago by former Deputy Danny Reid at the same Price. He later traded the vehicle to Fry motors for a new car. Cowan summed up the general feeling about the automobile Quot the car is a Good buy but without the need i see no reason to buy it now Quot the Council also approved the plan for a new water line to the Burnet Industrial Park. Fifty per cent of the Cost of the line will be funded by the Farmers Home administration. Later they discussed the possibility of the City doing the work on the new line rather than letting bids for the work. Tippit told the Council that Omha would approve the work done by the City if separate books Are kept. Quot i m in favor of doing it ourselves Quot said Alderman Fry Quot but i think we ought to take bids. We might have someone who can do it cheaper than the City Quot it s Only fair to take bids Quot said mrs. Seidensticker. Wilcox indicated that his chief concern was Over the City a obligation to its new Industry announces for or Post Burnet a mrs. Ernestine Stanford became the first Candi Date to announce for Justice of the peace precinct 3, this week. The 47-year resident of Burnet county called herself Quot a candidate for change Quot in announcing for the seat currently held by Guy p. Ferguson. Quot we need a change in our county government Quot mrs Stanford said Quot All county officials must be reminded that we serve at the people s mrs. Stanford s statement continued Quot county government even More than any other level of government must be people oriented and convenient to their needs. Quot with this thought in mind when elected i will open a Branch office in Sherwood shores oper ated on a regular periodic basis for the convenience of this Section of the the wife of Pat Stanford a retired employee of Lara mrs Stanford was educated in Burnet schools then moved to Marble Falls after her marriage after her husband s retirement the couple moved to Bertram. He added that he Felt the City could handle the water line Job particularly with the City s buying Power. No decision was made tuesday night concerning the construction of the will relinquish Hwy. Parking Burnet the Burnet presbyterian Church has advised Burnet City manager Jack Tippit that tile Church will Quot gladly relinquish any claim to curb parking Quot on Hwy. 29, Quot As we feel this would Caus a traffic problem on sunday mornings Quot Quot we have suggested to the City attorney that when the ordinance is drawn up that All restrictions or exemptions of parking be omitted from the ordinance Quot the letter said. The Issue is a result of the state Highway department s decision to establish a Center turn line on Highway 29, the Burnet City Council two weeks ago approved an ordinance already drawn up which would allow curb parking on Hwy. 29 on sundays and during funerals at Clements funeral Home and the Church. Quot we have drawn from our personal knowledge of having bean situated on this Comer of Hwy. 29 and Pierce Street. We know of the driving and parking condition Lecont on Page a4 requested by Kindred in a letter dated sept. 6, 1977. Kindred s letter of sept. 6 said Quot my client Knight has asked me to advise him As to his Legal rights and remedies concerning redress for his injuries. I have informed him that it is my opinion that he has been defamed and lib eled and that he can validly maintain an action in the courts against your publication.
