Rate Division Challenged in Supreme Court
Washington January 9. A major rail road case reached the Supreme Court for argument as Akron Canton and Youngstown railways west of the Hudson river challenge the Interstate Commerce Commission order granting New England railroads a 15 percent increase in joint rates. The case raises whether the commission can group railroads for rate divisions under the Transportation Act and whether the blanket order improperly transfers funds among carriers. Former Judge Walter C. Noyes argued that the act requires voluntary equitable divisions and that the commission has exceeded its authority by creating an eastern group and shifting about 25 million dollars to New England railroads. The court set aside its session to hear further arguments.
