$300000 Suit Against L Heard At Superior Court

The major case in the Elevated railway litigation is before Judge Sherman with a $300000 claim by Columbia Theatre owner James J. Grace for noise damage from passing trains. Engineer Frank E. Sherry testified the tracks run within five feet of the building and that a sharp curve worsens noise, with switches and frogs adding rattling sounds. Grace bought the site in 1890 for $76000 plus 3600 feet rear for $42500 and, after building, rental income fell from $21000 annually to sporadic, with six tenants since the rail line’s arrival versus four in the previous twelve years. Cross-examination of Grace continues.
