Choate Defends United Shoe Company Against Government Claim
Attorney Choate argued the United Company formed in 1899 was a legal merger of three shoe machinery firms and not a monopoly. He said leases existed before formation and changes were not needed, that tying was limited, and that machines leased any time without restrictions. He noted the Goodyear McKay and Consolidated lines did not compete and that Eppler welting differed from Goodyear welter. The court was told the case hinges on legality and the “survival of the fittest” thesis.
