Supreme Court rules death by own action not defense in life policy
The Supreme Court reverses the Eighth Circuit and holds that Missouri law allowing denial of a life policy payment when death results from the insured person’s own action does not bar payout. The $5000 policy on James Whitfield of Kansas City, taken in 1900, is affected by a clause limiting such payment. Justice Harlan delivered the decision.
