Hearing Set For Prisoner Harvey Curtis At Supreme Court
The West Virginia Supreme Court will hear Harvey Curtis on September 1 as he seeks to overturn a life sentence under habitual criminal law. Justices denied habeas petitions from five other inmates at the same session. Curtis argues two prior Logan County felonies invalidated the life term and that the sentence should be the 1 to 10 years for breaking and entering. The prior convictions were grand larceny in 1948 and auto theft in 1949.
