Guard Reinstated After Marijuana Charge at West Virginia Prison

The West Virginia Civil Service Commission ordered the reinstatement of Alan L. Post as a correctional officer, ruling the Department of Corrections lacked sufficient evidence for his earlier firing on marijuana distribution charges. Back pay was denied despite the reinstatement, with the panel citing the later testimony as insufficient to retroactively justify back pay. The decision directs Post’s return within two weeks to a DOC facility under its control, not necessarily Moundsville.
