Judge to rule on strip mine waste fill expansion today
In Nicholas County, US District Judge Chuck Chambers delayed ruling on whether West Virginia DEP properly issued permits for Green Valley Coal to expand a waste fill by 12.5 acres. Plaintiffs argue the agency failed to assess impacts on Hominy Creek watershed and trout habitat. DEP contends current pollution stems from a 1950s mine pile. If permits lapse, Green Valley warns of 85 to 100 layoffs and two underground mines plus a coal plant closure could follow.
