West Virginia law expands surface owners rights over mineral drills
Charleston reports two new West Virginia laws effective Thursday extend surface owner control. Surface owners must be notified when permits are sought and can respond, with state power to adjust plans for hazards or water protection. The laws also guarantee automatic damages payments when wells are drilled on severed mineral rights, expand inspector limits, raise permit fees and bond, but stop short of allowing well relocation against owner wishes.
