Freight Rate Dispute Goes to Three Judges
A Virginia regulatory clash over intrastate freight rates between the State Corporation Commission and the Interstate Commerce Commission was sent to a three judge federal panel after brief hearings. The case centers on whether intrastate rates may be adjusted by federal action and has potential national implications for state versus federal regulatory authority. Seventeen Virginia railroads argued the ICC’s action favored intrastate shippers and that the ICC overstepped, while the ICC contends state rates were unlawful and would weaken state regulators. The judges will consider when the ICC can order rate changes and how intrastate pricing fits within federal oversight.
