Chicago December 10 delegates to the American Farm Bureau federation heard Chester C. Davis administrator of the agricultural adjustment act say the triple A would be rebuilt within the constitution if the supreme court rules against its structure. He highlighted three tests this month and urged Congress to shape a flexible program under the constitution regardless of the court ruling.
The West Virginia Supreme Court upheld the local option process for banning liquor sales. It rejected claims that the repeal amendment strips legislature of power and ruled the title supports local option. Barbour county court to set a date pending further action.
Navy planes and boats comb the Atlantic and nearby shores for three Americans missing after an army bombing plane ditched at night. Virgil Gulich twenty six is sentenced by Federal Judge Edward J. Moinet to twenty five years in Alcatraz for kidnapping James C. Shumway a Parkersburg West Virginia taxi driver. Gulich allegedly forced Shumway to drive to Ecorse Michigan last May and was convicted under the Lindbergh law.
In Lancaster Pennsylvania on December 10 a Witmer firemen's Christmas party turned chaotic when Santa Claus's whiskers caught light after a cigarette. Paul Rye acted as Santa, fellow firefighters removed the burning whiskers, and Rye received first aid for facial burns and is recovering at home.
Reports from Peiping say a Manchoukuoan army invaded southeastern Chahor, battling special police in Kuvuan as fighting paused. Tokyo sent a Japanese attache to urge restraint while Chinese authorities blamed errant notices. Students from Yen-Ching and Teine-Iya protested detentions and shifted to military and nursing training.

Government lawyers said they would appeal, arguing the act may be sustained and make the company liable for back taxes. Justice Adkins upheld the act except for provisions on hours and wages via collective bargaining.

Kanawha county administrator Ostrander reports WPA promises a list of relief workers at work and timely payments this week as crowds gather to protest delays.
