The Massachusetts Supreme Court upheld the new law limiting Executive Council powers. A group led by former Attorney General Clarence A. Barnes sought to block the referendum from the November ballot. The court also dismissed a mandamus petition in a separate challenge filed by Thomas C. Healey of Hyde Park.

Pepper Martin, famed St. Louis Cardinal of the 1930s, died at 63 in a McAlester hospital after a heart attack. LONDON AP A junior government minister resigned to gain more political freedom as Labor members oppose Prime Minister Wilson's backing of U S air raids on North Vietnam. CAB Denies Rehearing For Airline

The Civil Aeronautics Board refused by a 3 to 2 vote to rehear Northeast Airlines renewal of its New York to Florida route. Two dissenters argued hearings since 1962 were incomplete and data stale, fearing loss of Northeast service south of New York and reduced New England access to Philadelphia and Washington. The majority said updated data had been considered and upheld the decision.

Viet Rangers Flown To New Major Battle

Viet Rangers were airlifted into a major battle zone 40 miles southwest of Da Nang as government forces fought Viet Cong units. In a separate effort east of Saigon some 3,000 South Vietnamese troops were airlifted in the largest helicopter assault of the war, but no contact was made with the Viet Cong. Four Vietnamese soldiers died in an accidental airstrike and two more in a mortar attack.

Rusk Calls Censure Overdue for Communist Infiltration

Secretary of State Dean Rusk told a New York audience that the world should have long recognized Communist infiltration of troops and arms across borders as aggression. He stressed Hanoi directs the guerrilla war in South Vietnam and urged end to aggression if possible by diplomacy or defeat. Rusk spoke at a Council of the International Chamber of Commerce meeting.

Moscow Withholds ICC Finding

London reports Britain will publish the International Control Commission's Viet Nam report as a white paper next Monday. The ICC majority from India and Poland and a Canadian minority statement were circulated to Geneva conference members. the Soviet Union refused to circulate. Britain notes Moscow has not replied to diplomatic overtures on a peace settlement and hints at a broader Southeast Asia strategy.
