Constitutional challenge hurled at Marlboro zoning
A constitutional challenge to Marlboro zoning went before the County Court on Wednesday with three hours of testimony, as attorney Kenneth V. Fisher Jr. contends the new two-acre minimum in Rural Residential areas and escalating lot sizes in planned sections violate municipal zoning aims. Testimony covered town planning intent, soil and water considerations, and potential subdivision counts on Fisher’s 150 acre site, while district officials noted limited pollution complaints and differing studies. The case highlighted local plans to balance rural character with development costs.
