Zoned-out developer sues to nullify Stamford zoning law

Frank J. Opie of Ayer Massachusetts has sued Stamford in Bennington County Chancery Court contending the town zoning ordinance blocks 3600 acres he owns. He seeks 1.8 million dollars plus 100 thousand for expenses and tax relief, arguing the ordinance confiscates land without compensation and declares it unconstitutional. The suit follows Stamford voters approving a forest zone restricting development, with 25 acre minimum lot sizes, and ongoing disputes over land sales to the U.S. Forest Service. The court has issued a temporary injunction against taxing the land, and Stamford must appear June 1 in Manchester to justify keeping the injunction.
