Arlington Faces Court Clash Over Town Land-Use Rules
Arlington planning chairman Clyde Putnam is urged to be removed after a court dispute between residents Thomas Whalen and Arthur O’Dea and the town. Whalen and O’Dea allege denial of a permit to open a retail store on East Arlington Road and seek a declaratory judgement confirming an approved permit. The town, via selectmen, says the town has no legal basis to challenge the complaint and supports the planning commission while criticizing Putnam’s role in delaying approvals. The dispute centers on an old Battenkill Tavern property later used as a drugstore and parking issues cited during permit reviews. O’Dea accuses Putnam of delaying and obstructing land-use by law. supporters say the planning commission erred in action and notes were not kept. Putnam is said to be vacationing in Arizona.
