Court strikes down 41 year old New York gun law

A New York State statute declaring a gun found in a car as presumptive evidence that all occupants possess it was ruled unconstitutional on its face by a three judge panel of the Second Circuit. The decision, written by Judge Walter R. Mansfield, upheld lower court dismissal of three men convicted on gun possession charges after two pistols were found in a car they occupied. The judges found the law cannot be sustained under Supreme Court standards for inferential evidence.
