New York Court Rules Student Loan Debt Cannot Trigger Bankruptcy
Albany The New York Court of Appeals on Thursday held that the desire to discharge student loan debt is not sufficient reason to declare bankruptcy. The ruling overturns a lower court decision in Whitney George Wilkes of Guilderland who owed 3892.56 and filed for bankruptcy in January 1970 while earning 9000 annually. The court noted Wilkes now earns 17000 and found his filing was solely to avoid repayment of student loans, a use of bankruptcy deemed illegal.
