Court says FTC should target truth of TV ads not visuals
The 5th U.S. Circuit Court of Appeals ruled that FTC must focus on misrepresentation of attributes in television commercials rather than substitution of a fake product for the real one. The court overturned a cease and desist order against Carter Products and agency Sullivan Stauffer Colwell Bayles, noting the foam in the ad used a special foaming agent, not ordinary lather.
