The Texas Supreme Court agreed to review a malpractice suit brought by Mrs. Elma Graves of Alice. She alleges a 1963 exploratory operation by Dr Philip Joseph at Physicians and Surgeons Hospital caused ongoing bladder trouble and partial paralysis. The trial court and San Antonio Court of Civil Appeals ruled the operation justified by emergency concern. the high court will hear three points of error including lack of emergency and patient consent issues.
