Court rules Darlington plant shutdown not unfair labor practice
The U S Circuit Court in Richmond Va held that shutting down the Darlington Manufacturing Co plant as retaliation for union activity is not an unfair labor practice. It said Darlington and Deering Milliken are a single employer. The 1956 closure followed a union vote by 258 to 252 and the NLRB claimed the mill was closed to avoid bargaining with the union.

Supreme Court narrows NLRB picketing ban in fruit strike case
The Supreme Court held the National Labor Relations Act ban on secondary boycotts does not apply to picketing in front of 46 Safeway stores urging customers to avoid nonunion Washington apples. The case arose from a Tree Fruits strike in Yakima area where Local 760 fruit workers picketed in December 1960 and January 1961. The Seventh Circuit case had ruled the ban did not cover such activity.

Supreme Court upholds FPC rule on price changing clauses
The Supreme Court, in an 8-1 ruling by Justice William Douglas, upheld a Federal Power Commission rule banning price changing provisions in long-term gas contracts. Justice Potter Stewart dissented. The Denver appeals court had vacated the rule, saying hearings were required case by case, but the high court affirmed broad Commission authority to regulate spiral escalation and price redetermination clauses.
