Revenue Act of 1932 Limits Loss Deductions on Short Holding Stocks

The Bureau clarifies section 23 (r) (s) (t) of the Revenue Act of 1932, limiting losses from stock and bond sales held two years or less to the gains from such sales. Losses from longer-held capital assets remain treated as under 1928. U.S. government and local bonds are excluded from the limit. Dealers, banks, and trust companies are exempt. Carryforwards apply to 1933 against gains from similar 1932 transactions. A numeric example shows how 1932 losses can be used only to the extent of 1932 gains and any excess may be carried forward within net income limits. Taxpayers must track holding periods to apply the rule correctly.
