Justices Uphold Governor's Removal Power Over Sheriff
A majority of Maine Supreme Judicial Court justices affirm the 1919 amendment allowing the Governor and Council to remove sheriffs after due process. The ruling rejects the claim that the Governor may not vote in removals, instead deeming the Governor and Council a quasi judicial tribunal with shared authority to determine unfaithfulness or inefficiency and to remove a sheriff upon finding of cause. Two dissenting justices argue the Governor cannot vote with the Council, maintaining the Governor sits outside the council for removal actions.

The interpretation hinges on legislative intent and whether council means the body or a joint tribunal. The court notes ambiguity and seeks the framers’ intent.
