Judge Learned Hand Urges Judicial Detachment in Theory
The Honorable Learned Hand, former Chief Judge of the Second Circuit, argues that judges must remain detached from social and political pressures. He says a judge is a mouthpiece for others expressed will and should override personal preferences when applying precedent. He supports using modern precedent if more applicable and favors collective jury opinion over bureaucratic authority. Hand, a leading national figure, notes his notable rulings on Communist leaders and Judith Coplon.
