City challenges Texas Civil Service Act as unconstitutional

The City of Austin argues in a Third Court of Civil Appeals brief that the state firemen and policemen civil service act is unconstitutional. City Attorney Trueman OQuinn says the act applies only to cities of 10 000 or more, excluding home rule cities starting at 5000, and that the act is a special law that could never apply to growing cities. He also contends sick leave benefits were never intended to be retroactive. The appeal follows a 126th District Court ruling in April that favored the city on wage scale but sided with employees on when sick leave and retirement benefits begin. Both sides appealed.
