Birmingham Southern Held Common Carrier by ICC

Washington reports the Interstate Commerce Commission ruled the Birmingham Southern railroad is a common carrier and eligible for joint rates with other lines. A 6.5 cent per ton division on carload traffic was adjusted, with plans for other carriers to align divisions on less than carload traffic. The Birmingham Southern, controlled by the Tennessee Coal, Iron and Railroad Company, will have switching charges at Birmingham and Beavemer, Alabama, and joint rates for outside switching areas. The majority opinion, by Commissioner Meyer, supports the ruling. Chairman Harland dissented, arguing the Birmingham Southern is a plant facility of Tennessee Coal and Iron and that the decision discriminates against non-proprietary shippers. The article notes New Zealand offering a bonus for improved flax flour extraction and promotes Peg o’ My Heart at Atlanta theaters.
