Ruling in Stock Yards vs Railroad Case in Louisville
In a United States court in Louisville Judge Evans ruled that under the interstate commerce act a party cannot sue in equity without a prior award from the interstate commerce commission. Without such an award the complainant must seek damages at law before a jury, so the suit for an injunction to force freight delivery was dismissed for lack of jurisdiction. Attorneys to appeal will travel to Cincinnati to pursue the case in the United States court of appeals.
